1. Who we are

Apex Notes is sold by Apex Alpha Trading Ltd, a company registered in England and Wales, company number 16782448. Registered office: 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. “We”, “us” and “our” mean Apex Alpha Trading Ltd. “You” means the person who subscribes.

These terms apply to your Apex Notes subscription. By subscribing, you agree to them.

2. What Apex Notes is

Apex Notes is a paid subscription to weekly market notes, sent to you by email with the full note attached as a PDF.

Apex Notes is Educational Market Commentary. It covers our reading of markets, the themes we are watching and the reasoning behind our views. It is for education and information only.

3. Not investment advice

Nothing in Apex Notes is investment advice or a personal recommendation. Nothing in it is a recommendation or an offer to buy, sell or hold any investment. It does not take your circumstances, objectives or attitude to risk into account.

Apex Alpha Trading Ltd is not authorised or regulated by the Financial Conduct Authority. We do not manage money, and we do not act as a broker, investment adviser or financial adviser.

Investing involves risk. The value of investments can go down as well as up, and you may lose some or all of the money you invest. Capital at risk. Past views or outcomes are not a guide to the future. Any decision you make is yours. If you need advice, speak to an adviser authorised by the FCA.

4. Who can subscribe

You must be at least 18 years old to subscribe. Apex Notes is for your personal use as an individual.

5. Plans and price

Apex Notes is available monthly at £10 a month, or yearly at £100 a year. Prices include VAT where it applies. The price and plan are shown to you at checkout before you pay.

6. Billing and renewal

You pay in advance for each monthly or yearly period. Your subscription renews automatically at the end of each period, and we charge the card you gave us, until you cancel.

You can switch between the monthly and yearly plans in the subscriber portal. Any adjustment for the change is shown to you there before you confirm.

7. Cancelling

You can cancel at any time in the subscriber portal. The link is in every email we send you.

When you cancel, your subscription stops renewing. You keep access, and keep receiving issues, until the end of the period you have already paid for. After that it ends, and we send you an email to confirm.

8. Your 14-day withdrawal right and refunds

Apex Notes is digital content, and you get access straight away. At checkout you are asked to agree to this by ticking a box that reads: “I agree to the Terms and understand I get immediate access to Apex Notes and lose my 14-day withdrawal right once the first issue is delivered.”

Because of this, we do not give refunds once access has begun. That includes refunds for part of a period after you cancel.

This does not affect your rights under the law. If you are charged twice, charged by mistake, or charged for something you did not receive, contact us and we will put it right, including with a refund where that is due.

9. Failed payments

If a renewal payment fails, your access is paused while the payment is failing, and no issues are sent to you. Our payment provider will try the payment again over the following days and will email you asking you to update your card.

If a later payment succeeds, your access starts again. We then send you each Apex Note that went out while your access was paused, once each.

If all the retries fail, your subscription is cancelled. Issues from the unpaid period are not sent.

10. Delivery

Apex Notes is delivered by email to the address you gave at checkout. Please keep that address up to date and able to receive our emails. We aim to publish each week, but an issue may occasionally be late or skipped, for example over holidays. A late or missed issue on its own is not grounds for a refund. If we stop publishing for an extended period, you may cancel and we will discuss a fair refund for the unused period.

11. Personal use only

Your subscription is for you alone. You may read, download and keep the notes for your own personal use. You may not share, forward, copy, republish, sell, resell or distribute the notes, in whole or in part. This includes posting them in groups, channels or websites. The notes remain our property. We may end the subscription of anyone who breaks this term, without a refund.

12. Price changes

We may change the price of Apex Notes. If we do, we will email you at least 30 days before the new price applies to you. The new price applies from your next renewal after that notice. If you do not want to pay it, you can cancel in the portal before that renewal, and you will not be charged the new price.

13. Changes to these terms

We may update these terms from time to time. If a change materially affects you, we will email you before it takes effect, and you may cancel if you do not agree. The current version is always at letter.apex-trading.co.uk/terms.

14. Our responsibility to you

We take care in preparing Apex Notes, but we do not promise that it is complete, accurate or up to date. You should not rely on it as the basis for any investment decision. As far as the law allows, we are not responsible for any loss arising from decisions you make using Apex Notes, or for losses we could not reasonably have foreseen. Our total responsibility to you for your subscription is limited to the amount you paid us in the 12 months before the claim.

Nothing in these terms limits or excludes our responsibility where the law does not allow it. That includes death or personal injury caused by negligence, fraud, and your statutory rights as a consumer.

15. Your personal data

We use your details to run your subscription and send you Apex Notes. Our privacy notice at letter.apex-trading.co.uk/privacy explains how.

16. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you may also bring proceedings in your local courts. If you live in the European Union, you also keep the protection of the mandatory consumer laws of your country.
